What is HB 837? Florida House Bill 837 (HB 837) establishes protections against liability for apartment and multifamily housing property owners who implement specific crime prevention measures, known as Crime Prevention Through Environmental Design (CPTED). These measures must be documented through an assessment conducted by a law enforcement agency or a Florida Crime Prevention Through Environmental Design Practitioner (FCP). According to the new F.S. 768.0706(2): “The owner or principal operator of a multifamily residential property that substantially implements the following security measures has a presumption against liability for criminal acts committed by third parties who are not employees or agents of the owner or operator:” Physical property requirements include: Security camera systems at entry and exit points that record and maintain video footage for at least 30 days, aiding in offender identification and apprehension; a well-lit parking lot with an average illumination of at least 1.8 foot-candles per square foot from dusk until dawn; adequate lighting in walkways, laundry rooms, common areas, and porches; a minimum 1-inch deadbolt on each dwelling unit door; locking devices on each window, exterior sliding door, and any other non-community purpose doors; locked gates with key or fob access along pool fence areas; and a peephole or door viewer on each dwelling unit door lacking a window or adjacent window. Section 768.0706(2)(b) also mandates that the owner or principal operator of the multifamily residential property have a crime prevention through environmental design assessment, no more than 3 years old, completed and documented by a law enforcement agency or Florida CPTED practitioner. By January 1, 2025, the owner or principal operator must provide crime deterrence and safety training to current employees, with ongoing training required for all new hires within 60 days.
